Terms of Service

1. Introduction

Welcome to Herographers ("Platform", "we", "us", or "our"). By accessing or using our website at www.herographers.com and any related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please discontinue use immediately.

Herographers is a managed on-demand visual services marketplace connecting clients with professional photographers and videographers across Malaysia. We are registered and operate under the laws of Malaysia.

2. Definitions

  • "Client" — any individual or entity booking photography or videography services through the Platform.
  • "Creator" — any photographer or videographer registered and approved on the Platform to provide services.
  • "Booking" — a confirmed request for photography or videography services made through the Platform.
  • "Deliverables" — the photographs, videos, or other visual content produced as a result of a Booking.
  • "Service Tier" — the level of service selected (Hero Mobile, Hero Standard, or Hero Pro).

3. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use this Platform. By using the Platform, you represent that you meet this requirement and have the legal capacity to enter into binding agreements.

4. Account Registration

  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

5. Service Tiers

Herographers offers three service tiers:

  • Hero Mobile — Mobile-based content creation for social media, reels, and casual shoots. Creators are auto-assigned based on category and proximity.
  • Hero Standard — Professional DSLR/mirrorless photography with in-house editing by Herographers. Creators are auto-assigned based on category and proximity.
  • Hero Pro — Premium, curated photographers hand-picked by Herographers. Clients browse and select their preferred creator. Creators handle their own editing.

Pricing varies by tier, category, location, and timing. All prices are displayed in Malaysian Ringgit (MYR) and are inclusive of platform service fees. Dynamic surcharges may apply for weekends, public holidays, same-day bookings, and golden hour sessions.

6. Bookings & Payments

  • A Booking is created when you complete the booking flow and confirm payment details on the Platform.
  • Bookings are subject to creator availability. We will notify you promptly if a creator cannot be assigned.
  • All payments are processed securely through our approved payment partners. We do not store your payment card details.
  • Prices displayed at the time of booking are final. We verify all prices server-side to prevent discrepancies.
  • Add-on packages (prints, frames, photo books, rush delivery) are optional and charged separately.

7. Cancellation & Refund Policy

Client Cancellations:

  • 48+ hours before session: Full refund to original payment method.
  • 24–48 hours before session: 50% refund. The remaining 50% compensates the assigned creator for reserved time.
  • Less than 24 hours before session: No refund. Creator has already prepared and reserved the time slot.
  • No-show: No refund. The full booking amount is forfeited.

Herographers Cancellations:

  • If we are unable to assign a creator, you will receive a full refund or the option to reschedule at no additional cost.
  • If a session is cancelled due to severe weather conditions or force majeure, we will offer a full reschedule or refund.

Refund Processing:

Refunds are processed within 7–14 business days, depending on your payment provider. Platform service fees are non-refundable for cancellations made less than 48 hours before the session.

8. Session & Delivery

  • Sessions begin at the scheduled time. Please arrive at the specified location on time.
  • Standard session duration is 1 hour unless otherwise specified in the booking.
  • For Hero Standard and Hero Mobile tiers, all photos are edited in-house by the Herographers editing team.
  • Delivery timeframes are typically 48–72 hours for edited photos. Rush delivery (24 hours) is available as an add-on.
  • You will receive a link to your private photo album where you can view, select, and download your photos.
  • For Hero Standard tier, you may select up to 12 photos included in your package. Additional photos are available at RM15 per photo.

9. Intellectual Property

Client Rights:

  • Upon full payment, you receive a non-exclusive, perpetual, worldwide license to use the Deliverables for personal, non-commercial purposes.
  • Commercial usage rights (advertising, product packaging, resale) require a separate commercial license. Contact us to arrange this.
  • You may share Deliverables on social media with appropriate credit to Herographers and the creator where possible.

Creator & Platform Rights:

  • Creators retain copyright ownership of the Deliverables unless otherwise agreed in writing.
  • Herographers and the assigned creator may use Deliverables for portfolio, marketing, and promotional purposes unless the client opts out in writing before the session.
  • All Platform content (logos, design, software, text) is owned by Herographers and may not be reproduced without written permission.

10. Creator Terms

  • Creators on the Platform are independent contractors, not employees of Herographers.
  • Creators agree to maintain professional conduct, arrive on time, and deliver quality work.
  • Creators are responsible for their own equipment, transport, and insurance.
  • Creator earnings are paid to their Platform wallet after successful order completion. Withdrawals are processed within 3–5 business days.
  • Platform commission rates vary by tier: 50% for Mobile and Standard, 10% for Pro.
  • Creators may not solicit clients directly or redirect Platform bookings to private arrangements.

11. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of Malaysian law.
  • Misrepresent your identity or provide false information.
  • Interfere with or disrupt the Platform's operation or security.
  • Attempt to bypass payment processing or manipulate pricing.
  • Harass, threaten, or behave inappropriately toward creators, clients, or staff.
  • Scrape, crawl, or use automated means to extract data from the Platform.
  • Circumvent the Platform to arrange direct bookings with creators.

12. Disputes & Resolution

  • If you are dissatisfied with the Deliverables, you must raise a dispute within 7 days of delivery through the Platform.
  • We will review disputes in good faith and may offer a partial refund, reshoot, or additional editing at our discretion.
  • Disputes that cannot be resolved amicably shall be referred to mediation under the Malaysian Mediation Centre.
  • These Terms are governed by the laws of Malaysia. Any legal proceedings shall be brought in the courts of Malaysia.

13. Limitation of Liability

  • Herographers acts as a marketplace connecting clients and creators. We do not guarantee specific outcomes from any session.
  • To the maximum extent permitted by Malaysian law, our total liability for any claim arising from these Terms or the Platform shall not exceed the amount you paid for the relevant Booking.
  • We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
  • We are not liable for any loss or damage caused by events beyond our reasonable control (force majeure), including but not limited to natural disasters, government actions, or pandemic-related restrictions.

14. Indemnification

You agree to indemnify and hold harmless Herographers, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

15. Modifications

We may update these Terms from time to time. Material changes will be notified via email or a prominent notice on the Platform. Continued use of the Platform after changes constitutes acceptance. We encourage you to review these Terms periodically.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
